Apple Urgently Appeals in US Court Over Blood Oxygen Feature Patent Violation

This comes in the aftermath of the decision by the administration of President Joe Biden to reject altering the ruling of the United States International Trade Commission (ITC), prompting Apple’s swift response through this appeal.
Apple Seeks Removal of Import Ban in the United States
The appeal specifically requests the removal of the ban imposed on importing Apple Smartwatches into the United States, citing the alleged infringement of the Blood Oxygen feature’s patent. The ban, effective since December 26, pertains to the sale of Apple Watch Series 9 and Watch Ultra 2 in the US, as ruled by the ITC in October 2023 in response to the patent dispute.

The Dispute Unveiled : Apple Watch
- Medical technology company Masimo has long accused Apple of stealing its pulse oximetry technology and incorporating it into the popular Apple Watch. In 2020, Apple introduced the Pulse Oximeter feature in its Series 6 model, making it a standard feature in subsequent smartwatch releases.
- In 2020, Masimo filed a case against Apple, alleging theft of trade secrets and patent infringement. They claimed that Apple violated one of their ten patented pulse oximetry technologies during the launch of Watch Series 6. The court ruled in favor of Masimo.
- Following this, in October 2023, the US International Trade Commission (ITC) upheld the court’s decision, resulting in a ban on Apple selling Series 9 and Watch Ultra 2 models in the US.
September Launch of Apple Watch Series 9 and Watch Ultra 2
In September of this year, Apple launched the Apple Watch Series 9 and Watch Ultra 2 in eight color options. Series 9 introduced the Double Tap feature, allowing users to answer calls with a double tap, while a double tap could also end a call. The GPS variant of Apple Watch Series 9 is priced at $399, the GPS + Cellular variant at $499, and the Watch Ultra 2 at $799.
